Bad Faith
Our lawyers prosecute and defend bad faith actions for wrongful denials of tender, rescission, broker and cedant breach of fiduciary duty, and general insurer misconduct.
On behalf of underwriters, claims professionals, and policyholders, we help navigate through common law duties of good faith and fair dealing, statutory unfair claims practices acts, and consumer fraud and protection laws.
Casualty Defense
We represent corporations, municipalities, and individuals in complex property and casualty liability cases across the United States.
Our lawyers have defended general contractors, construction managers, developers, property owners, product vendors, manufacturers, distributors, warehouse owners, and trucking, shipping and marine entities in hundreds of cases.
Coverage
We handle sophisticated insurance coverage matters from every stage of proceeding.
We investigate claims, draft and issue coverage opinions, prosecute, defend, and try declaratory judgment and breach of insurance contract actions, and handle arbitrations and alternate dispute resolutions.
Our lawyers deal with a breadth of coverage issues, including third-party tenders of defense, additional insured status, late notice, trigger of occurrence, pollution exclusions, claims-made (and reported) wordings, products and completed operations, errors and omission claims, guaranty fund claims, insolvency and liquidation matters, allocation issues, and premium funding.
Reinsurance
Our lawyers assist and represent reinsurers and their cedants with their coverage, litigation, internal auditing, monitoring, and strategic market needs.
Subrogation
We represent the subrogated interests of property, marine, cargo, and other first-party insurers in litigation across the United States.
We view the practice as a cross-discipline requiring not only expertise in engineering and technical issues but also an understanding of the impact of insurance coverage, and frequently, state and federal regulations.
Our lawyers prosecute claims arising out of fires, pipeline ruptures, storage contamination, explosions, boiler, machinery and equipment breakdown, component part failure, gas and water leaks, and other accidents which lead to catastrophic losses.
